Terms of service

Last updated: October 28, 2026

These terms are the agreement between you and Mars & Julia when you use our website or buy from us. Please read them before ordering. Our Refund Policy, Shipping Policy and Privacy Policy are part of these terms.

1. Who we are

"Mars & Julia", "we" and "us" mean Daye and Knite, a Massachusetts partnership trading as Mars & Julia. You can reach us at support@marsandjulia.com or by mail at PO Box 230092, Boston, MA 02123, USA.

These terms cover marsandjulia.com, shop.marsandjulia.com, and everything you buy from us there. By placing an order, you agree to these terms. If you don't agree, please don't order.

2. Who can buy

  • To place an order you must be 18 or older, or have a parent's or guardian's permission, and they must agree to these terms for you. If a parent or guardian's card is used, they're responsible for the order.
  • You need a shipping address in the United States (see our Shipping Policy).
  • Please give us accurate details: your name, email and address. We aren't responsible for orders that can't be delivered because of incorrect details you gave us.

3. Preorders

Our shirts are sold as a preorder:

  • The preorder is open from October 30, 2026 until 11:59 pm Eastern Time on November 13, 2026. Orders count by the time Shopify records them.
  • We print the shirts after the preorder closes. They're expected to ship from late November to early December, and every order will ship by December 14, 2026. That date is based on our printer's quoted turnaround. Delivery after shipping depends on the carrier, so we can't guarantee a delivery date.
  • You pay the full price, including shipping, when you order.
  • If we can't ship by December 14, 2026, we'll follow the "If we're late" steps in our Shipping Policy, including your right to cancel for a full refund.

4. Your order

  • After you order, you'll get an order confirmation email with your order number (it starts with #MJ). This confirms we've received your order and payment. Our agreement to sell is complete when we send that email, except in the cases in section 5.
  • Cancellations, changes, replacements and refunds work as described in our Refund Policy. In short: you can cancel or change sizes before the preorder closes; after it closes, we can't cancel or take back shirts for change of mind. If a shirt arrives damaged, faulty, misprinted or wrong, it comes back to us on our prepaid label and we refund it (or replace it, if we have a spare in your size).

5. When we can cancel an order

We may cancel an order, with a full refund, if:

  • a price or product detail on our site was clearly a mistake
  • we can't make or ship what you ordered
  • we reasonably suspect fraud or use of a payment method without permission
  • you've made a false damage or fault claim before (for example, a shirt sent back as faulty arrived with nothing wrong with it). We may refuse any future orders from you.
  • for any other reason, as long as your order hasn't shipped.

We'll tell you by email if this happens.

6. Prices, payment and tax

  • All prices are in US dollars.
  • Shipping is calculated at checkout before you pay (see our Shipping Policy).
  • Payment is processed at checkout by our payment providers. You'll see the available methods at checkout.
  • Sales tax: we don't currently charge sales tax on our shirts. If the law ever requires us to, it will be shown clearly at checkout before you pay.
  • We may change prices for future orders at any time. A price change never affects an order you've already placed.

7. Product details

  • We try hard to show our shirts accurately, but colours on screens vary, and our shirts are garment-dyed, so each one can be a slightly different shade. This isn't a fault.
  • Our size chart uses the shirt maker's own measurements, which can differ slightly from shirt to shirt. Please check it before ordering, because after the preorder closes we can't exchange sizes you chose.
  • The shirts are Comfort Colors C1717 heavyweight tees. Each product page lists the material and where it's made. Follow the care label to keep them looking good.

8. Delivery and responsibility for your package

We send your order to the address you gave. Once tracking shows your package was delivered to that address, it's your responsibility. Our Shipping Policy explains what we do if a package is lost, damaged or returned to us before that.

9. Our designs and content

The Mars & Julia name, logos, shirt designs, photos and everything else on our sites belong to us or the people who licensed them to us. Buying a shirt lets you wear and enjoy it. It doesn't give you the right to copy, print or sell our designs. Please don't copy or reuse our sites' content without our written permission.

10. Using our sites

Please don't misuse our sites: no attempting to break into them, disrupting them, using automated tools to buy up stock or place orders, or using them for anything illegal. We may block or cancel orders from anyone who does.

Our sites use services run by others (for example, Shopify runs our store and checkout). Their own terms apply to their services.

11. If something goes wrong

  • Our shirts come with the protections the law gives you, including the right to goods that are fit for their normal use. Nothing in these terms limits any rights you have under the law, including Massachusetts consumer protection law.
  • Apart from those rights, and as far as the law allows, we aren't responsible for losses that weren't reasonably foreseeable, or for anything outside our reasonable control (see "Things outside our control" in our Shipping Policy). Where the law allows us to limit what we owe you, the most we'll owe for an order is what you paid for it.

12. Disagreements

  • If you're unhappy with anything, please email us first at support@marsandjulia.com. Most problems can be fixed quickly that way.
  • These terms are governed by the laws of the Commonwealth of Massachusetts, USA. That doesn't take away any protection you have under the laws of the state where you live.
  • There's no arbitration clause in these terms. If we can't sort something out by email, either of us can go to a court that has jurisdiction, including small claims court.

13. Other legal points

  • If a court decides any part of these terms can't be enforced, the rest still applies.
  • If we make an exception for you once (for example, a refund or reship our policies don't require), that doesn't change these terms or our policies, and we can still apply them later.

14. Changes to these terms

We may update these terms. The version that applies to your order is the one in place when you placed it. The date at the top shows when they last changed.
